Transposition of the Directive 2014/67/EU

The principles laid down in Directive 2014/67/EU concerning the transnational posting of workers in the framework of the provision of services were transposed into Legislative decree No 136/2016




On 22 July 2016 Legislative decree No 136/2016 came into force (published in the Official Journal, General Series No 169 of  21 July 2016) transposing the Directive 2014/67/EU of the European Parliament and Council of 15 May 2014, which abrogates the previous Legislative decree No 72/2000 relating to Directive 96/71/EC. The provisions apply to companies –whether established in another Member State or in a country outside the EU- that post workers to a receiving company in Italy. The decree regards transnational postings within the same group of companies, or to a branch/production unit or other receiving company, as well as postings made by temporary staff providers from other Member State to a 'user' company that has either its registered office or production unit in Italy. The new framework provides better protection for workers, ensuring at least the same conditions of employment for equal work as those who are employed directly by the "user" company, and gives guidance concerning the identification of a genuine posting.
