COVID-19: validity of the A1 form for posting workers


New indications from INPS concerning the posted workers who are currently forced to stay in the Hosting Countries

By the mean of the communication number 1633 sent by INPS on April 15th 2020, the Institute steps in on the subject of free movement of individuals within the Community and relevant applicable legislation.

In this regard, the Institute states that, due to the current epidemic alert, the validity of the A1 forms, released by the Institutions members of the European Financial Area pursuant to rules 11 and 12 of the Regulation number 883/2004 (Ce), and expiring in the period between January 31, 2020 an July 31, 2020, in the event that the posted worker is forced to remain in the Hosting Country, the rule must be considered valid till the end of the state of emergency, July 31st 2020, (as provided for by the Decision of the Council of Ministers of January 31st, 2020, and published on the Official Journal on February the 2nd 2020); this rule must considered valid also wherever the explicit request of derogation, as referred to in the article number 18 of the Rules of Procedure ( CE) n. 987/2009, is not applied, (pursuant to article 16 of the Rules of Procedures (CE) 883/2004).
